The contract within the company’s organisation
CSB Avocats advises the company on preparing the offer, drafting the contract and negotiating with the candidate’s legal adviser. Duties, reporting lines, delegated authority and mobility provisions are defined by reference to the proposed organisation.
The firm reviews the proposed working time regime and the conditions for implementing it. Contractual status is assessed for consistency with the responsibilities and autonomy of the role.
Remuneration and incentives
The work covers base salary, variable pay, objectives, joining guarantees and benefits. The firm checks the relationship between the employment contract and the documents governing deferred bonuses or equity arrangements.
Allocation, service, vesting and departure conditions are reviewed with the advisers responsible for the plans and corporate decisions. The company’s commitments are considered alongside the authority of the person making them.
Provisions with continuing effects
The firm prepares probation, confidentiality, exclusivity, non-compete and departure provisions. It considers additional commitments requested by the candidate and their consistency with existing arrangements.
Where recruitment includes corporate office, appointment decisions and employment commitments are distinguished and coordinated. The resulting documents reflect the role and agreed joining timetable.
