CSB Avocats acts when a departure is being considered, has been announced or is already under way. The firm reviews duties, status, working conditions, remuneration and the chronology of discussions. It identifies established facts and missing documents before defining a negotiating position.

A French mutually agreed termination, dismissal and other ways of ending employment are subject to different conditions. The appropriate route is considered in light of the client’s position, steps already taken and the consequences of each option.

Matters for negotiation

Discussions may address timing, termination payments, variable pay, deferred entitlements, non-compete obligations, duties until departure and communications. Equity arrangements are reviewed separately through their governing documents.

The firm assesses potential claims, their legal basis and the limits of the evidence. Financial proposals are informed by that assessment, without a predetermined promise of recovery.

Discussions and documentation

CSB Avocats negotiates with the company’s legal adviser and refers proposals to its client. It prepares and reviews employment documents, the signature timetable and obligations to be performed after agreement.

Where corporate office or equity incentives are involved, negotiations are coordinated with decisions by the relevant corporate bodies and other advisers. If no agreement is reached, the firm assesses the appropriate litigation options.
